However, there are specific definitions that must be applied when determining if an accidental or unexpected death was really a “wrongful death.” In New York, wrongful death is defined as death that has been caused by a wrongful or neglectful act of another person that could have been answered with a personal injury claim had the victim survived. When a loved one dies in New York as a result of another person’s wrongful action (or inaction), certain people have the right to seek compensation in what is essentially a personal injury lawsuit on the deceased person’s behalf.

According to New York statute, the personal representative of the decedent's estate may file a wrongful death claim on behalf of:

  • A spouse of the decedent
  • A parent of the decedent
  • A child of the decedent
  • Other named beneficiaries of the decedent

This individual, the person named as representative of the estate, is the only one who can file a wrongful death claim. They are filing, however, to seek damages for losses suffered by the beneficiaries and heirs of the decedent. Generally, siblings and cousins of a decedent also have the right to pursue a wrongful death case in New York, unless they have also been named as the guardian or personal representative of the decedent.
