New York City is one of the most pedestrian-friendly and bicycle-friendly cities in the United States. The Big Apple’s walkability and plethora of bike lanes means the majority of New Yorkers have abandoned cars for more eco-friendly options. As accommodating as it is to cyclists, is it legal to bike on the sidewalk in New York City? The answer is pretty straightforward:
No. It is illegal to bike on sidewalks in New York City. Walking with your bike on the sidewalk is, however, allowed. The only exception to the rule is if the rider is age 12 or under and the diameter of their bicycle’s wheels is under 26 inches.
Keeping sidewalks free of cyclists is safer for pedestrians and riders alike. Luckily, there are plenty of other options around New York City for people in search of places to ride — because biking on a sidewalk in NYC can result in some serious consequences.
What Are the Penalties for Biking on the Sidewalk in New York City?
Biking on a sidewalk is considered a misdemeanor in New York City. The penalties for doing so can include:
- Hundreds of dollars in fines
- Bicycle confiscation
- Up to twenty days in prison
If your bike is taken, you may be responsible for impound fees and/or unable to retrieve your bike until all fines or bail has been paid. You are entitled to a hearing with the environmental control board within five business days of your bike being impounded. You can avoid the holding fees or receive a refund if the environmental control board rules in your favor.
