Holding Negligent Drivers Accountable

For car accident victims to recover damages from the at-fault party, they must show that the defendant’s negligence more likely than not caused their accident and injuries.

Common factors that cause car accidents include:

  • Distracted driving
  • Drunk driving
  • Speeding
  • Traffic violations

Our car accident attorneys in Brooklyn are focused on determining what happened and why. We want to present all the facts of the crash clearly and convincingly on your behalf. When we can establish fault and liability, our clients have the best chance of recovering the compensation they deserve.

What is Personal Injury Protection (PIP) Insurance?

When it comes to car accident laws, New York is a no-fault state. After an accident, the victim usually files a claim with their own insurance to recover compensation for their financial losses through a specific type of mandatory insurance called Personal Injury Protection (PIP) insurance. The law prohibits personal injury claims filed against other drivers unless the claimant was “seriously injured” in the crash.

Under the law, a “serious” injury involves:

  • Broken bones
  • Permanent disfigurement or injury
  • Substantively full disability for at least 90 days

Filing a third-party claim against another driver allows the claimant to pursue more non-economic damages and economic damages, whereas PIP coverage only compensates for economic damages. For example, the aforementioned damages about your pain and suffering cannot be achieved if you only use your PIP coverage after a crash.

Millions of Dollars in Compensation for Our Clients

Our Brooklyn car accident lawyers have successfully recovered millions of dollars in compensation for victims injured in all types of auto accidents. We can even manage claims involving more uncommon accidents, like those involving taxicabs, Uber/Lyft, and uninsured or underinsured drivers.

Some of our most recent and notable case results include:

  • $2,600,000 settlement during trial for a driver with spinal injuries suffered in a motor vehicle accident.
  • $1,000,000 settlement for a driver injured in a head-on collision and requiring neck surgery.
  • $875,000 settlement for shoulder injuries suffered by a passenger parked in a vehicle struck by a runaway van.
  • $700,000 verdict for a passenger who suffered shoulder and knee injuries in a motor vehicle collision.
  • $700,000 settlement before trial for an elderly driver whose neck and back were injured in a collision.

Can You File a Car Accident Claim If You Were Partially At Fault?

New York follows a "pure comparative fault" rule when it comes to car accidents and injury claims. This means that even if you are partly responsible for the accident, you are still eligible to pursue compensation. "Pure comparative" means that no matter how at fault you are, you can still pursue damages from the other party, but your percentage of fault will be reduced from your total compensation.

For example, if you are found to be 15% at fault for an accident, then your total compensation awarded to you would be reduced by 15%. Of course, keep in mind that you can’t file a third-party claim at all unless you are seriously injured.

How Long Do I Have to File a Car Accident Claim?

New York has a three-year statute of limitations for car accident claims. This means you have three years from the date of your accident to file a claim. Once that time has passed, you no longer have the ability to file a claim and pursue compensation.

You do not have three years to notify your auto insurance provider about the accident, though. You could have as little as 10 or so days to tell them. Ideally, you will tell them shortly after you hire our firm, which should be done within 24 or 48 hours of a crash.
