What is Personal Injury Protection (PIP) Insurance?
When it comes to car accident laws, New York is a no-fault state. After an accident, the victim usually files a claim with their own insurance to recover compensation for their financial losses through a specific type of mandatory insurance called Personal Injury Protection (PIP) insurance. The law prohibits personal injury claims filed against other drivers unless the claimant was “seriously injured” in the crash.
Under the law, a “serious” injury involves:

- Substantively full disability for at least 90 days
Filing a third-party claim against another driver allows the claimant to pursue more non-economic damages and economic damages, whereas PIP coverage only compensates for economic damages. Can You File a Car Accident Claim If You Were Partially At Fault?
New York follows a "pure comparative fault" rule when it comes to car accidents and injury claims. How Long Do I Have to File a Car Accident Claim?
