Filing a Car Accident Claim in New York

Holding Negligent Drivers Accountable

For car accident victims to recover damages from the at-fault party, they must show that the defendant’s negligence more likely than not caused their accident and injuries.

Common factors that cause car accidents include:

Our car accident attorneys in Brooklyn are focused on determining what happened and why. We want to present all the facts of the crash clearly and convincingly on your behalf. When we can establish fault and liability, our clients have the best chance of recovering the compensation they deserve.

What is Personal Injury Protection (PIP) Insurance?

When it comes to car accident laws, New York is a no-fault state. After an accident, the victim usually files a claim with their own insurance to recover compensation for their financial losses through a specific type of mandatory insurance called Personal Injury Protection (PIP) insurance. The law prohibits personal injury claims filed against other drivers unless the claimant was “seriously injured” in the crash.

Under the law, a “serious” injury involves:

  • Broken bones
  • Permanent disfigurement or injury
  • Substantively full disability for at least 90 days

Filing a third-party claim against another driver allows the claimant to pursue more non-economic damages and economic damages, whereas PIP coverage only compensates for economic damages. For example, the aforementioned damages about your pain and suffering cannot be achieved if you only use your PIP coverage after a crash.

There are certainly some benefits to PIP insurance, but there are also serious downsides. For instance, PIP insurance caps are often much lower than what is actually needed to pay for all damages, like medical bills and lost wages. In order to get appropriate compensation to cover the full extent of your damages after a car accident in Brooklyn, including pain and suffering, disability/lost wages, and unpaid medical bills, you will need to file an injury claim directly against the negligent driver that hit you.

When we file a personal injury claim against the other driver on your behalf, we demand the full amount of all damages including your past and future pain and suffering, the losses due to disability and lost wages, and payment to cover your medical bills, including if you will need treatment in the future.

How Long Do I Have to File a Car Accident Claim in New York?

New York has a three-year statute of limitations for car accident claims. This means you have three years from the date of your accident to file a claim. Once that time has passed, you no longer have the ability to file a claim and pursue compensation.

You do not have three years to notify your auto insurance provider about the accident, though. You could have as little as 10 or so days to tell them. Ideally, you will tell them shortly after you hire our firm, which should be done within 24 or 48 hours of a crash.

Can You File a Car Accident Claim If You Were Partially At Fault?

New York follows a "pure comparative fault" rule when it comes to car accidents and injury claims. This means that even if you are partly responsible for the accident, you are still eligible to pursue compensation.

"Pure comparative" means that no matter how at fault you are, you can still pursue damages from the other party, but your percentage of fault will be reduced from your total compensation.

For example, if you are found to be 15% at fault for an accident, then your total compensation awarded to you would be reduced by 15%. Of course, keep in mind that you can’t file a third-party claim at all unless you are seriously injured.

What To Do After a Motor Vehicle Accident in Brooklyn

Mva Checklist New Number

What facts do I need to gather after an accident?

After a car accident, it is important that you gather the following information:

  • The name, address, telephone number, and driver’s license number of the other driver
  • The other driver’s insurance company and policy number
  • The license plate number, color, make, and model of the other driver's vehicle
  • The names and contact information of any witnesses
  • A copy of the police accident report, including the police officer’s name, department, and badge number
  • The location of the accident
  • Photos or videos of the scene of the accident, including damage to vehicles and any injuries

What if I don’t feel hurt after an accident? Should I still see a doctor?

Some injuries, like neck or back injuries, may not show symptoms until days or even weeks after an accident. Even if you don’t immediately feel hurt after a collision, it is extremely important to obtain a medical evaluation. This is important for two reasons: one, you risk a more serious or long-term injury if you wait too long to seek treatment, and two, delaying care could seriously harm your personal injury claim and the amount of compensation you are eligible to receive.

If I think an accident is my fault, should I say so?

Even if you suspect the accident may have been partially or fully your fault, avoid making any admissions of guilt to the other driver, their insurance company, or anyone else. There may have been other factors that contributed to your accident that you might not yet be aware of. Don’t make any statements or sign any papers until you consult with a lawyer.

Should I talk to the other driver’s insurance company about a settlement?

Never give the opposing insurance company an oral statement. Remember, the insurance company wants to avoid a payout and can use anything you say against you. They are specially trained negotiators who will use every psychological technique to get you to admit something that will hurt your claim. If you are contacted, politely decline to comment. Then, get in touch with an attorney who will protect your best interests and fight to maximize the value of your case.

Can I afford a car accident lawyer?
